Terms of Use

These Terms of Use ("Terms") govern your access to and use of Emunah AI (the "Service"), operated by Emunah ("Emunah AI", "we", "us", or "our"), available at https://emunahtrips.com/. By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. What Emunah AI Is — and Is Not

Emunah AI is an AI-assisted travel search engine. Its sole function is to interpret the travel-related queries you submit and deliver relevant travel options and links to third-party providers and merchants.

Emunah AI only acts as a search engine that delivers results for your travel queries. Emunah AI is not a travel agency, tour operator, booking platform, or merchant of travel products. We do not:

  • sell, supply, or fulfil any travel product or service;
  • take, confirm, or manage any booking or reservation;
  • process, collect, or handle any payment for travel products; or
  • set the prices, availability, terms, or conditions of any third-party offering.

Any booking, purchase, or transaction for a travel product is made solely between you and the relevant third-party merchant, on that merchant's website and under that merchant's own terms. (See Section 7.)

2. Definitions

  • "Guest" — a user who uses the Service without an account.
  • "Registered User" — a user with a free account.
  • "Premium Subscriber" — a user with an active paid subscription.
  • "Merchant" — any third-party provider, platform, or affiliate partner whose products, services, or websites are linked or referenced through the Service.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

4. Accounts and Access Tiers

a. Tiers. The Service is offered in tiers — Guest, Registered, and Premium — which may carry different daily usage limits and features, as enforced by us. We may set, change, or enforce usage limits at any time to ensure fair use and protect the Service.

b. Registration limits and waitlist. Account registration may be capped. If registration is temporarily full, you may be offered a waitlist, and we may grant access as capacity allows.

c. Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. You may not share, sell, or transfer your account, and you may not maintain multiple accounts to circumvent limits.

5. Premium Subscriptions, Billing, and No Refunds

a. Payment processor. Premium subscriptions are processed by our third-party payment provider, PayMongo. By subscribing, you also agree to PayMongo's applicable terms. We do not store your full payment-card details.

b. Pricing. Premium prices, periods (such as one month or one year), and features are those displayed on the upgrade/checkout page at the time of purchase. We do not state prices in these Terms; the price shown at checkout governs.

c. Prepaid periods; no automatic renewal. Premium is purchased for a fixed period (such as one month or one year). Your Premium access begins when payment is confirmed and ends at the end of the period you purchased. Premium does not renew automatically, and you will not be charged again unless you choose to purchase another period. If you purchase another period while your Premium is still active, the new period begins when your current period ends. If we ever offer automatic renewal, it will apply only if you choose to turn it on, and we will tell you before any automatic charge.

d. End of Premium. Because Premium does not renew automatically, there is nothing to cancel. When your paid period ends, your account reverts to the Registered (free) tier. We may send you a reminder before your Premium ends; purchasing another period to keep Premium is up to you.

e. No refunds. All payments are non-refundable. We do not provide refunds, credits, or pro-rated returns for any subscription period — including for partially used periods or unused access — except where a refund is strictly required by applicable law. To the maximum extent permitted by law, all fees paid are final.

f. Price changes. We may change Premium prices or features prospectively. A price change applies only to purchases made after it takes effect; a period you have already paid for is not affected.

6. Affiliate Relationships and Compensation Disclosure

Emunah AI participates in affiliate and referral programs. When you click certain links or results and take a qualifying action on a Merchant's website, we may earn a commission or fee from that Merchant, at no additional cost to you. Affiliate relationships do not change the price you pay the Merchant. Our inclusion or ranking of any result is not an endorsement, guarantee, or recommendation of any specific Merchant or offering.

7. Third-Party Merchants and Transactions

This Section is important.

When you click a result or link in the Service, you leave Emunah AI and are taken to a Merchant's own website. Any transaction you enter into — including any booking, reservation, purchase, payment, change, or cancellation — is solely between you and that Merchant, and is governed entirely by the Merchant's own terms, conditions, pricing, and policies.

Emunah AI is not a party to any such transaction and has no control over and no responsibility or liability for, among other things:

  • the accuracy, availability, quality, safety, legality, or pricing of any Merchant product or service;
  • the completion, confirmation, fulfilment, modification, delay, or cancellation of any booking or reservation;
  • any payment, charge, overcharge, refund, or chargeback by or with a Merchant;
  • any act, omission, error, or conduct of any Merchant; or
  • any loss, damage, injury, or dispute arising from your dealings with any Merchant.

Any dispute relating to a travel product must be raised directly with the Merchant. We are not responsible for resolving disputes between you and any Merchant.

8. AI-Generated Results — Accuracy Disclaimer

The Service uses artificial intelligence to interpret queries and generate results. AI output can be incomplete, outdated, or inaccurate, and prices and availability shown through the Service may differ from those on the Merchant's website. Results are provided for convenience and informational purposes only and do not constitute professional, travel, financial, or other advice. Always verify all details — including price, availability, dates, terms, and travel requirements — directly with the Merchant before making any decision or payment. You rely on AI-generated results at your own risk.

9. Acceptable Use

You agree not to:

  • use the Service for any unlawful, fraudulent, or harmful purpose;
  • access, scrape, harvest, crawl, or copy the Service or its data by automated means (bots, scrapers, spiders) or otherwise circumvent or overload our rate limits, security, or access controls;
  • attempt to gain unauthorized access to any part of the Service, other accounts, or our systems;
  • reverse engineer, decompile, or attempt to extract source code, models, or underlying logic;
  • resell, redistribute, or commercially exploit the Service or its results without our written permission;
  • interfere with or disrupt the integrity, security, or performance of the Service;
  • submit unlawful, infringing, or malicious content, or use the Service to transmit malware; or
  • misrepresent your identity or use another person's account.

We may investigate and take any action we deem appropriate, including limiting, suspending, or terminating access, and reporting activity to the authorities.

10. Availability, Limits, and Changes to the Service

We provide the Service on an "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time, and access from certain regions may be blocked. We may add, change, suspend, limit, or discontinue any part of the Service (including features, tiers, and limits) at any time, with or without notice.

11. Intellectual Property

The Service — including its software, design, text, graphics, logos, and the "Emunah AI" name and branding — is owned by or licensed to us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms. You may not use our names, logos, or branding without our prior written consent. All rights not expressly granted are reserved.

12. Your Content

To the extent you submit any content (such as queries or saved items), you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store that content as needed to operate and improve the Service. You are responsible for the content you submit and represent that you have the right to submit it.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranties arising from course of dealing or usage. We do not warrant that the Service, or any results obtained through it, will be accurate, reliable, complete, secure, or error-free.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Emunah AI, and its operators, owners, officers, employees, and suppliers, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, or your dealings with any Merchant, even if advised of the possibility of such damages.
  • Emunah AI will not be liable for any loss or damage arising from any Merchant, third-party website, booking, transaction, or content accessed through the Service.
  • To the extent we are found liable despite the above, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the three (3) months immediately before the event giving rise to the claim, or (b) PHP 1,000.

Some jurisdictions do not allow certain limitations; in such cases, the limitations apply to the fullest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Emunah AI and its operators, owners, officers, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or third-party right, or your dealings with any Merchant.

16. Suspension and Termination

We may suspend, limit, or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, abused the Service, or created risk or legal exposure for us or others, or for any other reason. You may stop using the Service at any time and may delete your account from your Account page. Provisions that by their nature should survive termination (including Sections 6–9 and 11–18) will survive.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Governing Law and Disputes

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws principles. You agree that the courts located in the Philippines will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to their jurisdiction and venue, subject to any mandatory rights you may have under applicable consumer-protection law.

19. General

  • Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
  • No waiver. Our failure to enforce any provision is not a waiver of it.
  • Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements.
